Criminal Procedure (Reform and Modernisation) Bill - Submission

The Police Association welcomes the Criminal Procedure (Reform and Modernisation) Bill as the culmination of a lengthy project to revise and consolidate criminal procedure statute.

The Association believes this Bill should assist in promoting greater efficiency in the criminal justice system without compromising the interests of justice.

Covered in this submission are issues of particular interest to the Association, including: the requirement of somebody who wishes to commence a private prosecution to provide prima facie evidence of an offence sufficient to justify a trial, before a Judge may accept the charge for filing; time frames around filing formal statements; allowing a case to proceed in the absence of a defendant; and the issues surrounding celebrity name suppression.
